Government project took clearance from NBWL; private project didn’t apply for even clearance
Environment Impact Assessment Authority has not taken any action till now
in Chandigarh that have been completed without having clearance from NATIONAL BOARD FOR WILDLIFE as directed by Supreme Court after the writ petition of GOA FOUNDATION in 4 December 2006.
The Public Interest Litigation of GOA FOUNDATION vide WP No. 460/2004 before the Hon’ble Supreme Court regarding the issue of declaration of ECO SENSITIVE ZONES. Vide their Order dated 4th Dec 2006, Hon’ble Supreme Court had directed the Ministry of Environment & Forests that all cases where environmental clearances were granted, where activities are within 10 kms zone, be referred to Standing Committee of NBWL. (Annexure 2)
The State Level Environment Impact Assessment Authority; which is supposed to keep a check on the construction projects falling in 10 KM Eco-Sensitive Zones around sanctuaries; have not done anything so far.
Chandigarh has two Wild Life Sanctuaries – the Sukhna Wildlife Sanctuary and the Sector 21 Bird Sanctuary. Both Eco Sensitive Zones are not notified yet. This is why the radius of 10 Km of these sanctuaries is falling in Eco Sensitive Zones by default as per Ministry of Environment and Forests. (Annexure 4), hence these private projects are mandated to take NBWL clearance even before construction begins or else imprisonment with fine could be imposed on project proponents.
Even Ministry of Environment and Forest Regional Office has issued notice to some project proponents that their project lied in 10 Km Eco-sensitive Zone and they should obtain the approval from NBWL, but till date no approval been asked by them. Annexure (5-6).
Taruni Gandhi Director Saarthi For Environment have knocked the door of Hon’ble Punjab and Haryana and UT Administration Kaptan Singh Solanki along with evidences. We also had put this matter before Ministry of Environment and Forest but till date no action been taken. (Annexure 7)
We wish to elaborate here that PM Modi is coming in city for International Yoga Day and in his dream city where, the Chairman of National Board for wildlife is no body but himself (Prime Minister Narendra Modi); the NBWL laws violated here fearlessly.
